| Seattle | Seattle/Vancouver Visa Query Posted: Sun June 8, 2008 11:55 AM UTC
I have a friend who is planning to travel to Vancouver from Seattle and back again.
She has a UK passport, would she be able to get back into the US (Seattle) after spending a couple of days in Vancouver? She would already have spent a month in the US prior to entering Canada. Would she encounter any problems? I assume she would be entering the States again with a 2nd Visa waiver. |

No problems but it will not be a 2nd visa waiver. For that you/he/she has to leave the North American continent.

>>>* VWP travelers who have been admitted under the Visa Waiver Program and who make a short trip to Canada, Mexico or an adjacent island generally can be readmitted to the United States under the VWP for the original admission period. See the Department of Homeland Security’s Customs and Border Protection (CBP) website for additional details.<<<<

The previous two answers are exactly correct. The implication of that is that on her 2nd visit to the USA after Canada, she could only stay around 58 days before having to return to the UK because the original visa waiver is for 90 days.

If you travel before Jan 09 the above are correct
but if you travel after Jan 09, be aware of visa waiver changes The US government just announced changes to the Visa Waiver program that add requirements for all people travelling from Visa waiver countries ... expected to take effect in January of 09 Info on US government websites: http://www.unitedstatesvisas.gov/visanews/index.html and http://www.dhs.gov/xnews/releases/pr_1212498186436.shtm and http://www.dhs.gov/xnews/releases/pr_1212501117599.shtm It's not clear to my reading whether this will affect travellers arriving by private car

The ESTA applies for the first inbound entry under VWP and then it is valid for 2 years. So it doesn't affect the intermediate travel to Canada. Nor any other travels to the US within those 2 years.
Still, under VWP (and consequently ESTA), the 90-day rule including the side trip to either Canada and Mexico still is in force, thus the above answers are still valid. Said otherwise: nothing in that aspect has changed. By car: that is precisely answered on the (3rd) website you gave! Read your own information better!
