My son has recently been arrested, not yet been charged but has admitted being involved in an incident where someone was assaulted - wrong place wrong time not with his usual group of friends, although I'm not condoning - I'm gutted. First offence - never even been in trouble at school. Our holiday was booked last Sept for beginning of July this Year . Just waiting for his new passport to come back and we can go ahead and make the appt which they have told us will be April/May. He needs a form from the Association of Police Officers (that replaces the old subject access form)and the staff at that office were very helpful.The local police see no reason why he can't travel as if charged he may not have even gone to court by the time of the holiday.Does anyone have any further advice of other supporting documents which may help his case, seening as he will not have been convicted and the charges(if charged) may change. I know this may seem like hes being rewarded but he has actually helped pay a large sum of moneyfor this holiday and at the moment hes not been charged and I have other family memebers to consider..Any advice would be extremely grateful.Thanks.

i hope someone can help - a difficult situation
but if no one on VT has expertise - maybe consult a lawyer or talk to the relevant consulate i don't know where you are traveling to - and I am sure you are all hyped up about this but in this tricky and difficult situation there are probably experts who can help you see what is possible and what is not

Thanks for the prompt reply and kind words. Yes this situation has totally thrown us into turmoil. We are off to Orlando it is our last big family holiday as well, before his brother goes off to uni. I have spoken briefly to the solicitor who will deal with his case if hes is eventually charged, however he is not sure either, this seems an unusal case even the US embassy helpline weren't too sure . All they have is a list of paperwork anyone whose been arrested or convicted needs to bring but it seems that most people applying are over 18 and have already been convicted.

my sister in brisbane australia has just returned from taking her family there and did the san diego zoo and a brief jaunt into tijuana ok now i have got the picture

my thought is - it is all a bit risky
if he turns up at the airport with you guys he may be turned away - some official doesn't like the paperwork??? so you just abandon him at the airport as you as a family fly away me - solid - i would find a safe place for him - some brutal grandmother in Brighton who would keep a really stern eye on him and have a curfew and leave him behind it is too risky and strange

When you cross the Atlantic as you approach the USA, The Plane crew will pass out cards that have to be filled out to give to US immigration when you land. On that card is a question that asks: Have you ever been ARRESTED or convicted of a "crime of Moral Turpitude"? Now the question is: does your Son's incident meet that definition?? If not, and he can answer NO on the form, he will free to enter I think. You should not need a Visa as the UK is able to come here without a Visa. But if his "Crime" fits the defintion, you will have to take him to the USA embassy and get a Visa. Otherwise leave him home........

Is there a way you could find out what info is shared re young offenders between your government and the US?
As he was 16 at the time his records may be sealed.
