Not punished, but warned and asked to erase the picture if taking the one of Lenin in front of the presidential palace in Tiraspol town. As an advise, cross the street and take it from the other side of the street. The view is better and you won't be seen behind the trees by the guards who are located in the building.
All the other statues of Lenin are fine to take pictures of.
